Omaha Children's Museum Parking Agreement

PARKING SPACE RENTAL AGREEMENT

THIS PARKING SPACE RENTAL AGREEMENT (this “Agreement”) entered into as of the date of last signature below, is by and between the renter (“Tenant”) and Omaha Children’s Museum, Inc., a Nebraska non-profit corporation (“OCM”). In consideration of the mutual promises and covenants contained herein, the parties agree as follows:

1. Parking Lot. OCM hereby rents to the Tenant, and the Tenant rents from OCM, [ONE parking space in the] parking lot located at OCM’s premises at 500 S. 20th St., Omaha, NE, 68102 (the “Parking Lot”). Tenant agrees to use the Parking Lot for parking of automobiles (“Vehicle”) only. The Tenant agrees to park only one Vehicle in the one parking space in the Parking Lot. OCM will provide ONE parking permit per Agreement that the Tenant must visibly display in the front window of the Vehicle. The Tenant agrees that the parking permit issued with this Agreement will only be used with the same registered Vehicle.

2. Rental Date. OCM hereby grants the Tenant access to use the Parking Lot on a 30 day basis starting on the date the Tenant receives the parking permit. (the “Rental Date”).

3. Fee. The fee payable by the Tenant shall be $20.00 USD, which amount is due in its entirety on or before the initial Rental Date and then due again on or before the 30 day renewal date if the Tenant wishes to continue this Agreement.

4. Disclaimer. The Tenant agrees that no promises, representations, statements, or warranties have been made on behalf of OCM to the Tenant respecting the condition of the Parking Lot. By accessing and using the Parking Lot, the Tenant acknowledges that the Parking Lot is in good and satisfactory condition when possession was taken. The Tenant affirms its understanding that OCM does not furnish attendants for the parking of automobiles, and should any person, at the request of the Tenant, handle, move, park, or drive any vehicle placed on the Parking Lot, then such person shall be deemed an agent of the Tenant, and the Tenant, not OCM, shall be liable for any loss, damage, injury, or expense suffered or sustained in connection therewith. The Tenant acknowledges that this Agreement only provides the Tenant with limited access to the Parking Lot, and that OCM will not provide any services under this Agreement, including but not limited to providing security, monitoring the Parking Lot, or snow removal. OCM shall not be responsible for any damage to vehicles, persons, theft of vehicles or any part of a vehicle, or loss of personal articles from a vehicle. The Tenant may end this Agreement at any time. If the Tenant wishes to end the agreement previous payments made will not be refunded.

5. Indemnity. The Tenant shall indemnify, defend, and hold harmless OCM and its officers, directors, partners, agents, members, and employees from and against any and all demands, claims, damages to persons or

24/7 Parking per Space

- After you complete this form and pay, you will receive an email with your next steps to schedule a time to pick up your parking permit and to be assigned a designated parking space

- Parking is one vehicle per parking space with the parking permit displayed in the front windshield

- Parking permits are non-transferable between other vehicles and/or persons

- The 30 day parking begins the day you receive the parking permit

- DO NOT park in the parking lot without the parking permit, even if you have paid

- All unauthorized vehicles and vehicles without a parking permit will be towed at the vehicle owners expense

- OCM will not refund fees for any cancellations

- OCM shall not provide any services, including security or monitoring the parking lot

- OCM shall not be responsible for any damage to vehicles, persons, theft of vehicles or any part of a vehicle, or loss of personal articles from a vehicle
